Ich denke Nius baut hier falsch auf. Es geht hier nicht darum, ob Herr Günther als Ministerpräsident oder CDU Politiker gesprochen hat, das ist völlig irrelevant, selbst wenn er als Privatmann geredet hat.
Das gibt nur dem Gericht eine Ausrede, es nicht verurteilen zu müssen.
Fakt ist m.E. dass es sich um Beleidigungen handelt und das ist und sollte der Kern der Anklage sein.
Es ist nicht bewiesen, dass Nius ein Gegner der Demokratie ist und damit ist dies rechtlich eine Beleidigung der Art "üble Nachrede"
Die zweite Aussage das die Artikel vollkommen faktenfrei sind, muss Herr Günther dann auch beweisen, wobei das bei der Aussage "vollkommen" sehr schwierig werden sollte. Wenn das Gericht dies nicht feststellt, ist das eine Beleidigung der Art "Verleumdung"
Ich denke vor einem höheren Gericht dürfte man bessere Chancen haben, ein gerechtes Urteil zu bekommen.

I think Nius is building this argument on the wrong foot. It's not about whether Mr. Günther spoke as Minister-President or as a CDU politician; that's completely irrelevant, even if he spoke in a private capacity.
That only gives the court an excuse not to convict him.
The fact is, in my opinion, that these are insults, and that is and should be the core of the charges.
It hasn't been proven that Nius is an opponent of democracy, and therefore this is legally considered slander.
Mr. Günther also has to prove his second claim that the articles are completely devoid of facts, which will be very difficult given the word "completely." If the court doesn't find this to be true, it's defamation.
I think there would be a better chance of getting a fair verdict in a higher court.
That's my opinion.
